STRATEGIC PLANNING AND DECISION MAKING – Prior to selecting the agreement structure for developing and financing a major capital project, there needs to be a considered analysis of the alternatives and the specific goals and objectives desired by the participants. P3C can facilitate the early planning for project participants and stakeholders in evaluation of alternative financing and project delivery approaches for capital projects to optimize time, cost and funding efficiencies.

PROJECT TEAM BUILDING – Every major public private partnership will involve teams that will need to be established and organized on both the public and private sector side of the transaction. In addition, the PPP agreement is itself a teaming agreement between the public and private sectors. P3C can help facilitate this team building and craft agreements that can progress the development of the project structure through each phase of the project’s life cycle. In addition the use of formalized “partnering” workshops and periodic meetings can be implemented to maintain good working relationships.

PROJECT DEVELOPMENT AND STRUCTURING – P3C can provide cost effective assistance during project development, typically considered the period from project initiation through the first phase of the construction procurement. Critical decisions that drive cost and schedule are made during conceptual and preliminary engineering. P3C can provide a framework for value planning to evaluate these cost drivers and help scope a project and finance plan that meet budget. In addition P3C can assist in industry meetings and help analyze and incorporate industry suggestions into the procurement approach.

NEGOTIATION OF AGREEMENTS – P3C can assist in one or more of the project phases including: evaluating and choosing the optimum form and structure for the PPP agreement; working through environmental approval issues and stakeholder agreements; developing the initial term sheet(s); developing the initial development agreement; developing the implementation agreements (design build contract, financing agreements, operations and maintenance agreements, user fee setting agreements, agreements on limits to rate of return); and serving as a source of continuity during contract performance of agreements.

PERFORMANCE MONITORING – Once any long term and integrated contract approach is selected, it will need to be monitored by the partners during implementation. P3C can provide a neutral source for project monitoring and be in a position to advise the participants when performance issues arise in advance of the issues becoming problems or disputes. By conducting periodic project oversight reviews and peer reviews, problems can be addressed early on thereby minimizing impacts to the project.

EDUCATION AND TRAINING – Understanding and implementing new forms of project delivery requires a change in mind set, as well as an understanding of the best practices for all the parties to follow. P3C’s personnel have been involved in training and educating both the public and private sectors, in alternative contract delivery approaches, public private partnerships and collaborative conflict resolution for over 25 years. P3C can tailor a program that fits the client’s needs and implement training with the people who have experience on successful PPP projects.

COLLABORATIVE CONFLICT RESOLUTION – Dispute avoidance starts with an investment in contract negotiations and a balanced approach to risk and reward. However no agreement can prevent and eliminate all disputes and therefore must contain a program for resolution of disputes. P3C can help in establishing the program and structuring collaborative processes (mediation, structured negotiations, third party neutral reviews) for resolution of disputes that cannot be resolved at the project level.
